Offer terms & conditions
If you are applying to Enact Energy in response to a particular offer or incentive, please ensure you read the following Terms & Conditions and the relevant Offer Notice to your offer:
1. These terms and conditions together with any specific rules set out in Offer Notices (as defined below) are the Offer Rules ("Rules") and apply to competitions run by Enact Energy unless otherwise expressly stated. By entering an Offer entrants agree to be bound by these Rules.
2. The Offer is organised by Enact Energy Renewables Limited of Enact House, Tolvaddon Energy Park, Cornwall, TR14 0HX ("Enact Energy").
3. Rules specific to each Offer are displayed as notices below for such Offers ("Offer Notice") and are incorporated into the Rules. In the event of discrepancy between these terms and conditions and the Offer Notice, the Offer Notice shall prevail.
4. Enact Energy reserves the right to cancel or amend the Offer or the Rules without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside Enact Energy’s reasonable control. Any changes will be posted either within these terms and conditions or the Offer Notice. A copy of the Rules may also be obtained by sending a stamped addressed envelope to: Enact Energy, Enact House, Tolvaddon Energy Park, Cornwall, TR14 0HX
5. In the event of any dispute regarding the Rules, conduct, results and all other matters relating to a Offer, the decision of Enact Energy shall be final and no correspondence or discussion shall be entered into.
Qualifying Entrants
6. To qualify to enter the Offer you must be a permanent resident in Great Britain. The address you provide with your competition entry ("Entry") will be used to send any prizes/offers so please make sure this is correct.
7. Employees of Enact Energy or any company involved in the Offer or, if relevant, production of a television programme to which a Offer relates, or any advertising agency or web company connected with Enact Energy or any such person’s subsidiary or associated companies, agents or members of their families or households, are not eligible to enter the Offer.
8. Additional eligibility requirements may apply to a specific Offer.
9. By entering the Offer, you hereby warrant that all information submitted by you is true, current and complete. Enact Energy reserves the right to verify the eligibility of all entrants.
10. Enact Energy assumes that by entering the Offer (and you warrant that) you are aged 18 or over or, if you are under 18, that your parents have consented to your entry into the Offer and these Rules.
11. Enact Energy reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of the Rules.
12. In the event that any entrant is disqualified from the Offer, Enact Energy in its sole discretion may decide whether a replacement should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules.
Offer Entries
13. Only one entry/application per person per Offer is allowed (except where the Offer Notice states that more than one entry can be submitted).
14. Offer entries/applications must be made in the manner and by the closing date specified on the Offer Notice. Failure to do so will disqualify the entry.
15. Proof of posting or emailing cannot be accepted as proof of delivery. Enact Energy cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to Entries/applications, or Entries/applications lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.
16. Applicants should note that unless stated otherwise, Enact Energy does not accept responsibility for the return of any Entries/applications, including those consisting of artistic or other material.
Competition Prizes
17. Where a prize is linked to an offer, prize winners will be chosen at random unless specified otherwise in the Offer Notice, from all qualifying Entries within 28 days of the closing date if specified in the Offer Notice. Tie–breakers will be judged by Enact Energy and, if required by law, by an independent adjudicator. In all matters, the decision of the judge(s) and Enact Energy shall be final and no correspondence or discussion shall be entered into.
18. Prize winners will be notified in the manner and within the time specified on the Offer Notice. Return of any prize notification as undeliverable or failure to reply as specified in the notification (and within the time stated) may result in disqualification and selection of an alternate winner. Offer winner(s)’ names may be published on the website or you can write to Enact Energy, Enact House, Tolvaddon Energy Park, Cornwall, TR14 0HX naming the specific competition including a self-addressed stamped envelope for a list of winners.
19. Claims for prizes must be made in the manner and within the time specified on the Offer Notice. Failure to claim a prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.
20. Prizes are non–transferable. Enact Energy reserves the right to substitute prizes of equal or greater value at any time.
21. Prizes are awarded at Enact Energy‘s discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant.
22. Where a prize may not be appropriate for a younger contestant, the minimum age for entry will be stated in the Offer Notice and must be observed. Enact Energy reserves the right to request written proof of age of any winner.
23. All taxes, insurances, transfers, spending money and other expenses (including meals or personal expenses upgrades etc.) as the case may be, unless specifically stated, are the sole responsibility of the prize winner.
Intellectual Property Rights & Use of Entries
24. Enact Energy does not, unless we agree this with you, claim any rights of ownership in your Entry/application. As such, you retain ownership and, although Enact Energy will be able to use Entries/applications as set out in the Rules, you will also have the right to use your Entry in any way you choose. Where any Entry is to be used in a different way (e.g. we are asking to own this) this will be made clear on the website and you will then be able to choose whether to enter the Offer.
25. In consideration of Enact Energy agreeing to consider entrants a competition, each entrant hereby agrees that Enact Energy (and third parties authorised by Enact Energy) may make any and all Entries available on the website and any other media, whether now known or invented in the future, which may include other internet sites, mobile, television and/or radio and that Entries may be made available with advertising and/or sponsorship. You now grant Enact Energy (and third parties authorised by Enact Energy) a non-exclusive, worldwide, irrevocable licence (for the full period of any rights in the Entry) to use, display, publish, transmit, copy, make derivative works or podcasts from, edit, alter, store, re-format, sell and sub-licence the Entry for such purposes.
26. Enact Energy does not guarantee to use or otherwise make available any Entry to a competition. Enact Energy may, in appropriate circumstances, and at its sole discretion, reject, edit, remove or disable access to Entries that appear to be legally or otherwise problematic e.g. infringe the copyright or other intellectual property or privacy rights of others, are defamatory etc. or for any other reason.
27. Your entry and any information submitted by you must be personal to and relate specifically to you. You hereby warrant that your Entry and all information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. If relevant, Enact Energy reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same.
Liability
28. Enact Energy cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or Offer or as a result of accepting any prize or offer reward. Enact Energy is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant´s or any other person´s computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition or Offer. Nothing shall exclude Enact Energy´s liability for death or personal injury as a result of its negligence.
Data Protection and Publicity
29. Winners of competitions may be requested to take part in promotional activity and Enact Energy reserves the right to use the names and addresses of winners, their photographs and audio and/or visual recordings of them in any publicity.
30. Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual‘s prior consent. Please see Enact Energy’s privacy policy for further details. Data relating to entrants will be retained by Enact Energy for a reasonable period after the Competition closes to assist Enact Energy to operate competitions in a consistent manner and to deal with any queries on the Competition.
Jurisdiction
31. The Competition and Rules will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.

Offer and Competition Notices
Terms & Conditions for Enact Energy special solar electricity introductory offer: 3.76kWp system at £8,499
1. Prices apply to new orders placed from 4 November 2011 to 29 February 2012 (inclusive) only “Offer Dates”. Applications submitted outside the Offer Dates will not qualify for this offer.
2. Price applies only to a 3.76kWp system using 16 x 235Wp ET branded solar panels with a matched inverter.
3. All orders are subject to a suitability assessment. The price does not include additional work.
4. The offer price includes VAT.
5. These systems will only be available for installations taking place between 12 December 2011 and 17 March 2012.
6. All orders for solar electricity systems are subject to the standard terms & conditions of Enact Energy available on request or online www.enactenergy.com
7. These terms & conditions do not affect your statutory rights.
8. Offer subject to availability.
9. This offer may be amended or withdrawn at any time at Enacts discretion.
Price Match Promise Offer Terms & Conditions
This offer is operated by Enact Energy Renewables Limited (7057417) (“Enact Energy”).
Enact Energy will match its competitors’ prices for solar electricity systems, pursuant to these terms:
1. The offer is available from 11 May 2011 and up to and including the 31 December 2011 (the “Offer Dates”), subject to availability, and may change or be withdrawn at any time without prior notice at the entire discretion of Enact Energy.
2. Applications submitted outside the Offer Dates will not qualify for this offer.
3. By claiming a price match, the customer is subsequently no longer eligible for any other promotional discount unless such promotion clearly indicates to the contrary.
4. Enact Energy will match its price to that of a competitor, provided that all of the following items are, in Enact Energy’s opinion, equal to those offered by Enact:
(a) system specification;
(b) product quality;
(c) brand;
(d) installation lead time;
(e) deposit;
(f) terms and conditions of the provision of services;
(g) guarantees;
(h) warranties;
(i) terms of business.
5. The competitor providing the quote must be MCS accredited and the works must be carried out by MCS accredited installers and use MCS accredited products. The installer must also be a member of the REAL Assurance Scheme and all work must be carried out according to the REAL and MCS codes of contact.
6. To be eligible for the offer, the customer must provide a copy of the dated quote, clearly specifying the items listed in paragraphs 4 and 5 above, from the competitor of Enact Energy along with full contact details for the installer so that Enact Energy may verify the quote. Verification will be based but not limited to evidence in the form of a scanned written quotation, a URL or a screen shot of the website.
7. The competitor’s quote must contain written details of the design and specification of the solar panel system, together with product names, details of any additional items or special instructions and details of any deposit required and payment terms prior to any price being matched.
8. The competitor price to be matched must include VAT and any delivery or installation charges and can be a standard or promotional price.
9. Price matches will only be made on the selling price of the goods. Gifts, ‘giveaways’, or systems being given away for free will not be considered by Enact Energy.
10. The offer is only valid for 21 days after the date of the competitor quote. Quotes more than 21 days old will not be considered.
11. The offer is only valid when comparing the price of a residential solar electricity system under 4kWp offered by Enact Energy to that offered by another retailer in the Mainland Great Britain.
12. The offer does not apply to prices offered on auction websites or a competitor based outside of the United Kingdom.
13. If Enact Energy matches a competitor’s price and the competitor subsequently lowers their price Enact Energy will not match it a second time.
14. No more than the difference between the original price offered by Enact Energy and the price offered by its competitor will be discounted.
15. The one-off discount will only be applied by way of a discount to the total price of the solar electricity system purchased by the customer of Enact Energy and is non-transferable. No alternative remuneration is available.
16. Only one discount per purchase will be given to the customer.
17. Enact Energy reserves the right to refuse to match a competitor’s price for any reason at its discretion.
18. All orders for solar electricity systems are subject to the standard Terms and Conditions of Enact Energy.
19. Once an offer to price match has been made by Enact Energy, the customer must accept and pay a deposit within three working days.
20. These terms & conditions do not affect your statutory rights.
Free Home Insulation
1. Offer applies to new orders placed from 29 February 2012 (inclusive) only “Offer Dates”. Applications submitted outside the Offer Dates will not qualify for this offer.
2. Subject to a suitability assessment and limited funding.
3. If the property exceeds a maximum meterage (+ £5 per additional m2), requires additional works (scaffolding, roof vents, core vents, walkboards, pipe insulation, water tank insulation, extra wide cavities), or has more than 60mm of existing insulation you will be charged a contribution fee.
4. At the time of your free no obligation suitability assessment, your assessor will confirm if you will need to pay an additional contribution due to excess meterage or additional works.
5. Funding is not available for under tile insulation or where there is already more than 150mm/6 inches of existing loft insulation.
6. Enact Energy Home Insulation Service is currently only available in mainland Great Britain and the Isle of Wight.
