Legal information covering the Enact Energy Insulation Scheme

Enact Energy is a brand name used by the Enact group of companies. This service is managed by Enact Energy Renewables Limited registered in England and Wales Co. No: 7057417. Registered Office: 14 High Cross, Truro, Cornwall TR1 2AJ (“Enact”).

Enact uses a panel of third party installers who will carry out the cavity wall/loft suitability assessment of your property and also the installation of the cavity wall or loft insulation. The Installer who carries out the suitability assessment may not be the same Installer who carries out the installation of the cavity wall or loft insulation.

Interpretation
The definitions of interpretation below apply in these paragraphs:

Assessment Form: the cavity wall/loft insulation suitability and assessment form prepared by the Installer.
Installer: the allocated third party installer appointed by you to undertake an assessment and/or to install any measures as identified in the Assessment Form.
Services: the assessment as to the suitability or otherwise of your property for installation of energy efficient measures being cavity wall insulation and or loft insulation and/or the installation of such measures.

Background
Enact sources funding from various utility companies for the provision of energy efficient measures, in particular cavity wall and loft insulation, who will provide funding to customers by way of grants (where applicable). Enact refers the assessment and installation works to a panel of Installers and so you must contract with the Installer who will then carry out the suitability assessment and/or install such energy efficient measures under a separate contract for which Enact does not accept any liability whatsoever.
 
YOUR obligations
In order for the Installer to carry out the Services as efficiently as possible you must:

  • co-operate with us and/or the Installer in all matters relating to the provision of the Services;
  • provide us, the installer, our agents, subcontractors, consultants and employees, in a timely manner and at no charge, with access to your premises as reasonably required by us and/or the Installer;
  • provide to us and/or the Installer, in a timely manner, such information as may reasonably be required, including but not limited to landlords consent, proof of benefits and proof of age, and ensure that it is accurate in all material respects;
  • unless agreed with the installer, be responsible (at your own cost) for preparing and maintaining the relevant premises for the supply of the Services, including identifying, monitoring, removing and disposing of any hazardous materials from your premises in accordance with all applicable laws, providing a safe means of access from the public highway to your property, preparing the location within your property including the removal of belongings to enable the Services to be carried out, before and during the supply of the Services at those premises.

Charges and payment
You shall be responsible for paying the Installer for the charges due for the provision of Services in accordance with the terms of your agreement with the Installer should you decide to proceed with the installation.

Limitation of liability - THE CUSTOMER´S ATTENTION IS PARTICULARLY DRAWN TO THIS CONDITION
Nothing in these paragraphs limits or excludes our liability:

  • for death or personal injury resulting from negligence; or
  • for any damage or liability incurred by you as a result of fraud or fraudulent misrepresentation by us.

We shall not be liable for any actions or omissions of any third party including the Installer. In the event that you agree a limitation of liability with any third party, you agree that our liability to you will not be increased due to the limitation of liability agreed by you with third parties. Our liability to you under or in connection with the Services shall be limited to that proportion of the total losses (after taking into account any contributory negligence, if any) determined to be just and equitable having regard to the extent of our responsibility for the losses in question.

About your information and Data Protection
Enact Energy Renewables Limited is the data controller and is part of the Enact group. For more information about Enact please visit www.enactenergy.co.uk. Your data will be processed by Enact (“we”, “us”), other members of Enact’s group of companies, energy providers and one or more installers selected from Enact’s panel of installers (“Installer”).

Your privacy is very important to us and we promise that we will do our best to protect your personal information and make sure that it is accurate and kept up to date. You can help us do this by letting us know if there are any changes to your information.

What sort of information do you hold about me?
This will be all the details we and the Installer have about you (including any benefit details), and your property. It will include any information we get from third parties.

What do you do with the information?
Your information is used to help us:

  • assess the suitability of your property or enable an Installer to assess your property
  • refer the insulation works to an Installer to carry out works at your property
  • understand our customer’s needs and requirements
  • develop and test products and services
  • claim available funding from energy providers

Who do you share my information with?
We won’t share your personal information with anyone other than other members of Enact’s group of companies, energy providers from whom funding may be claimed and the Installer except:

  • where you have given us your permission
  • where we have to do so or allowed to by law
  • other companies that help us provide our service to you
  • where we may transfer our rights and obligations under this agreement

Do you send my information out to other countries?
We might do this, but only when we can be sure that your information will get an adequate level of protection. Your information might be assessed by law enforcement agencies and other authorities to prevent and detect crime or comply with other legal obligations.

What will happen if you change how my information is used?
We might do this from time to time. If we think you would not expect this change, we will write and tell you about it. If we don’t hear from you within 60 days, you agree to the change.

Can I see the information that you hold about me?

Will you send me marketing information?
We will only send you information about other Enact products that we think you would like to hear about and offers from other carefully chosen companies if you told us that you are happy for us to do this. You can change your mind at any time by contacting 0800 093 4050.
